Terms of Service

1. Introduction

Welcome to Hinata (also referred to as "NullTracker" or "the Service"), an advanced Discord security and logging bot developed by NullStudio Security Team ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Service.

By installing, enabling, accessing, or otherwise using the Service in your Discord server (a "Server"), you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

2. Acceptance of Terms

By using the Service you represent and warrant that you have the right, authority, and capacity to agree to these Terms on behalf of the Server and its administrators. Continued use of the Service constitutes acceptance of any updates to these Terms.

3. Service Description

Hinata is a modular Discord bot that provides security, moderation, logging, and utility features. Core capabilities include, but are not limited to:

• Anti-nuke protection - Detecting and mitigating mass role/channel/permission changes, mass kicks/bans, and automated rollback/recovery
• Moderation automation - Auto-bans, kick detection, role-management protection
• Comprehensive logging - Message edits, deletions, member join/leave, role updates, voice state changes, audit log events
• URL scanning and threat detection - VirusTotal integration for scanning suspicious links
• Spam and scam detection - Pattern analysis and automated mitigation
• Backup and recovery utilities - Channel/role snapshots and restore functions
• Premium subscription features - Tiered functionality accessed via secure payments

4. User Responsibilities

4.1 Permissions and Configuration

You are responsible for configuring the Service correctly within your Server, including granting only the permissions required for the features you intend to use (e.g., Manage Roles, Ban Members, View Audit Log).

4.2 Compliance with Discord Terms

You must comply with Discord's Terms of Service, Community Guidelines, and any applicable laws when using the Service.

4.3 Prohibited Uses

You shall not:

• Use the Service to engage in unlawful activities
• Reverse engineer the Service
• Access data you are not authorized to access
• Tamper with logs or attempt to circumvent monitoring and security features

4.4 Data Protection

Server administrators are responsible for informing their members of logging practices and complying with applicable privacy laws when exposing or sharing data collected by the Service.

5. Premium Subscriptions and Billing

Hinata provides optional premium subscription tiers to unlock additional features. Typical tiers include:

• Basic - $4.99/month: Core premium features and priority support
• Professional - $9.99/month: Advanced scanning, higher rate limits, additional backups
• Enterprise - $19.99/month: Top-tier features, enhanced support, multi-server management
• Custom Enterprise - Custom pricing and SLAs available on request

5.1 Payment Processing

Payments are processed by PayPal or other third-party processors. We do not directly store full payment credentials. Payment disputes and chargebacks are subject to PayPal's policies.

5.2 Billing and Renewal

Subscriptions typically renew automatically on a monthly cycle until canceled. It is your responsibility to cancel subscriptions through the provided billing interface.

5.3 Cancellations and Refunds

Cancellation policies and refund eligibility are defined in the subscription terms at the time of purchase. Refunds, if provided, are at our discretion and may be subject to PayPal's refund processes.

6. Service Availability

6.1 No Guarantee of Uptime

We aim for high availability (targeting 99.9% uptime where applicable), but we provide no guarantee of uninterrupted access. Downtime may result from maintenance, updates, or external service outages.

6.2 Maintenance and Updates

We may perform scheduled or unscheduled maintenance. We reserve the right to modify, suspend, or discontinue features or the Service as necessary.

6.3 Discontinuation

We may discontinue the Service or certain features with reasonable notice. We are not responsible for lost data resulting from any discontinued features beyond stated backup and export provisions.

7. Intellectual Property

7.1 Ownership

The Service, its source code, documentation, and related intellectual property are owned or licensed by NullStudio Security Team. Portions of the project may be provided under open-source licenses.

7.2 License

Where applicable, the project includes components licensed under the MIT License. The MIT License governs distribution and reproduction of those components.

7.3 Restrictions

Except as expressly permitted by applicable licenses, you may not copy, modify, sublicense, or redistribute proprietary portions of the Service.

8. Limitation of Liability

8.1 No Liability for Server Changes

We are not responsible for changes made to your Server by the Service when properly authorized through granted permissions. This includes automated moderation or security responses that you enable.

8.2 Third-Party Service Failures

We are not liable for failures or inaccuracies arising from third-party integrations (e.g., VirusTotal, PayPal, Discord API).

8.3 Data Loss

We are not responsible for data loss. Server administrators should maintain their own backups where appropriate.

9. Data Usage and Rights

9.1 Data Processing

By using the Service, you grant us the right to process and store Server and member data as necessary to provide core functionality (logging, moderation, backups, scanning).

9.2 Anonymized Data

We may aggregate and anonymize usage data for analytics and service improvements. Anonymized data will not identify individual users.

9.3 Export and Deletion

Administrators may export logs and request data deletion as described in the Privacy Policy. We will honor deletion requests subject to operational constraints and legal obligations.

10. Termination

10.1 User Initiated

You may remove the bot from your Server at any time. Upon removal, Server-specific data may be retained for a limited grace period to support recovery and billing reconciliation unless a deletion request is made.

10.2 Service Initiated

We may suspend or terminate access to the Service for violations of these Terms or unlawful activity. In such cases, we may delete or retain data as permitted by applicable law.
